Terms of Service

1. Acceptance of Terms

By downloading, installing, or using NotchWise ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Licence

NotchWise grants you a non-exclusive, non-transferable, revocable licence to use the App on macOS devices that you own or control, subject to these Terms.

  • Free tier: You may use the free version of NotchWise indefinitely with the limitations described on the pricing page (1 deck, 50 cards, SM-2 only).
  • Pro licence: A one-time purchase grants you a perpetual licence to use all Pro features, including all future updates to the current major version.

3. Restrictions

You may not:

  • Reverse engineer, decompile, or disassemble the App
  • Redistribute, sublicence, or resell the App or your licence key
  • Use the App for any unlawful purpose
  • Remove or alter any proprietary notices or labels

4. Intellectual Property

NotchWise and its original content, features, and functionality are owned by ABS Projects and are protected by copyright, trademark, and other intellectual property laws. Your flashcard content remains yours — NotchWise claims no ownership over content you create or import.

5. Your Content

You retain full ownership of all flashcard content, decks, and media you create or import into NotchWise. The App stores this content locally on your device. We do not access, view, or process your content in any way.

6. Third-Party Services

NotchWise may optionally interact with:

  • AnkiConnect — A third-party Anki plugin. Your use of AnkiConnect is governed by its own terms and licence.
  • Anthropic Claude API — If you opt into AI card suggestions and provide your own API key, your use of the Claude API is governed by Anthropic's Terms of Service.

NotchWise is not responsible for the availability, accuracy, or conduct of third-party services.

7. Disclaimer of Warranties

NotchWise is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be error-free, uninterrupted, or free of harmful components.

8. Limitation of Liability

To the maximum extent permitted by law, ABS Projects shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, arising out of or in connection with your use of the App, even if advised of the possibility of such damages.

9. Refunds

Purchases made through the Mac App Store are subject to Apple's refund policy. For direct purchases, we offer a 30-day money-back guarantee — contact notchwise.app@proton.me for assistance.

10. Termination

We may terminate or suspend your licence immediately, without prior notice, if you breach these Terms. Upon termination, you must cease all use of the App and delete all copies.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated date. Continued use of the App after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.
